Just a heads up to everyone- please read the descriptions from Potter and Potter very carefully. They are listing items as brand new when some have been opened. One they list as brand new, but in the description, they mention it has been opened and re-sealed.
Just my two cents but I think this is really a disingenuous and misleading practice. I hope more sellers do not start doing this.

It's a moot point.
Anything opened is not brand new, period. Not because it isn't in reality, but because it can't be proven otherwise once opened. You can open a Tenyo, use it once, and it's technically used at that point. This is true even if there isn't as much as a finger print on the prop.
Anything opened and legitimately new should be listed as "Opened in new condition", simple.

It seems to be getting worse and worse. For sure too many people use the NEW label. It can only be used on unopened items, ebay makes that clear.
This auctions is a shame as well. There is a house key that replaced the key with "Tenyo" stamped in it. This guy has been selling Tenyo for the past couple of years. He should know better.

And this just proves he is not someone whose descriptions fits the item. Using words like "good-fine" to describe the box and "new" for the prop are totally unfair.

I know the seller, Mike Henkel, and he's a good guy. I just think he doesn't know exactly what every Tenyo item should look like. Yes, he key from Zone Infinity is not right, and the Nest of Boxes is missing a few boxes!

I agree with Oliver and Tom on this one. If it has been opened, it's no longer new. It's perfectly fine to say opened but in new condition.
