The Internet Archive has loosened many of the restrictions they had on reading online books. Their collection includes works by Karl Fulves, Jim Steinmeyer, Nicholas Einhorn, George Schindler, Ricky Jay, Annemann, Walter Gibson, Blackstone, Bruce Elliott, Jean Hugard, Scarne dozens of books on Houdini, Paul Curry, Martin Gardner, and more.

The short answer is, anything you want is legal under the copyright law up until you get sued, and no one has sued them yet.

The long answer is a combination of § 108 of the Copyright Law, which gives libraries some interesting privileges, and the fact that Brewster Kahle (the head of the Internet Archive) has some expansive views on copyright which no one has yet successfully challenged (I think there may be a reluctance to sue him, for fear of losing and setting an unwanted precedent).

§ 108 says essentially that a library or archive is authorized to make "a" copy of a book, and (presumably) loan that out instead. The Internet Archive makes digital copies and loans them out. They have warehouses of physical copies of books which they have scanned. They will "loan" (give access for 2 weeks) you the digital copy, and normally no one else can "borrow" it while you have access. If you want to see, for example, their copy of Richard Kaufman's Knack Magic, you register, go through a process of "checking it out" as you would do at a conventional library, and you have access to a copy-protected digital version at the IA website for two weeks. If someone else wants to see it while you have it "checked out", they have to get on a wait list, and when the two weeks are up, your access ceases and they get a turn.

All this strikes me as a reasonable way to replicate the functions of a library in the digital age. It is called Controlled Digital Lending, and it has not been explored in the courts (as far as I know) -- whether it is legal or not has yet to be determined. The author is no worse off than he would have been if the physical copy of the book was loaned out (they got paid their royalty when the original physical copy was sold), and the contents of the book are made available to readers (which is the purpose of the copyright law anyway -- the author's rights are only a means to that end). Some grey areas are that the law doesn't specifically say that you can make a digital copy (it doesn't specifically say otherwise . . .) and that allowing me to read the digital copy makes a new additional (possibly unauthorized) copy on my computer (I'm not smart enough to save and download it to a permanent file, but I'm sure it could be done).

The news in what I linked to above is that the IA has turned off the waitlist for the duration of the current Coronavirus emergency, while nearly all public and school libraries are closed. They claim that it is "fair use" to allow multiple readers to have access to a work at once in these circumstances, since there is currently no access to physical libraries. This is a new claim of "fair use", and if they got sued over it, they might lose.

They also allow authors and copyright holders to opt their books out of this process. If Richard doesn't like the fact that I can read Knack Magic online at the same time as some other reader like this, he can email the IA and have the book set back to a "one digital copy only" status.

I would attribute good and sincere motives to what the Internet Archive is doing, even if it might be outside the letter of the law. Compassion for others and attempts to give them both a lift and a diversion during the challenges we all face right now is important and laudable.

The digital, IT and online age has created a new frontier for intellectual property law (which was super-complicated to begin with). It's like the "Wild West" period in U.S. history, and there are obvious difficulties in attempting to retrofit what is fast becoming an antiquated area of the law in order to accommodate legal issues never before seen, or even anticipated. And while the technology is moving at the veritable speed of light, law-makers and courts, comparatively speaking, are moving at the speed of...

...snail.
