Copyright on the posters themselves has expired, but Tashchen's photographs of them remain protected. It may not be so cut and dried. There is a case that deals with almost exactly the same issue, and it held that photographs meant to reproduce public domain art don't qualify for copyright protecti...

The issue was that Dover didn't shoot their own photos of those posters. They reproduced Taschen's photographs, an allegation that can be proved by the image of #58, which is uniquely autographed and sitting in Mike Caveney's collection, and was photographed specifically for the Taschen book. Departures from conventional spelling, punctuation, and grammar can be distracting, which can interfere with clear communication. But these are the bare mechanics of written communication. When someone is sloppy with these, it's usually a signal that they will also be sloppy with their organization ...

I think that kind of misses the point Ted. The guy lied outright. That's all that matters. Over on Facebook, Patrick speaks of suing and claims that he has damages, but doesn't hint at what they might be. Over here, he seems to claim reduced salesflow as the damages. Hence my focus on that aspect. ...
