Hey there folks, I have some amazing replica Morgan dollars sets up for grabs. These are truly the best I have ever seen. The are attracted to a magnet so the possibilities are endless. The hobbyist act protects people from owning these coins which have been out of circulation for over 50 years.The reason the Sudsbury penny had to have the word copy on it was because the penny is still in circulation. I am not going to get into a debate over this and will say if you do not want them great but if you do I have 3 sets left and then they will be gone. Thx

Here's the US Govt. information on the "Hobby Act." I don't see anything in there about ownership of items that haven't been in circulation for any time limit.

(c) Rules and regulations
The Federal Trade Commission shall prescribe rules for
determining the manner and form in which items described in
subsection (a) or (b) of this section shall be permanently marked.
(d) Exemption
Subsections (a) and (b), and regulations under subsection (c) of
this section, shall not apply to any common carrier or contract
carrier or freight forwarder with respect to an imitation political
item or imitation numismatic item received, shipped, delivered, or
handled by it for shipment in the ordinary course of its business.

The coins would fall under the imitation numismatic item label. My understanding is also that while no longer in circulation, the coins would still be legal tender thus technically it would be counterfeiting if they were not somehow marked as a copy or replica.

What exactly is meant by the term "for introduction into or distribution in commerce", would be the key point. Apparently, it would be legal to manufacture in the United States, or to import into the United States, imitation numismatic items if they were not intended to be introduced into or distributed in commerce.
I'm not sure if the transaction of selling the imitation coins, would in itself, constitute "distribution in commerce". An argument could be made that it does, however, a more clever argument could be made that it doesn't.
