With over 50,000 performances of the illusion they were bound to run into an idiot sooner or later. Given the way the world is, I'm surprised they didn't find this clown earlier.
In the end they'll probably settle because some juries are a nexus of morons and there's no sense chancing that.

I was involved in a lawsuit against one of the rock bands I work with. The guy claimed he had been deafened by a pyrotechnic explosion (he was standing in front of the stage next to the explosion).
The case came to a complete halt when we demonstrated that the explosion was soundless -- just smoke and pyro -- the sound of the explosion actually came from a mortar that was backstage and was detonated at the same time.
Obviously, if a guy standing in front of the stage could be deafened, then the band, onstage, would also be deafened -- and since didn't happen, his case was thrown out for what it was -- a money grab.

Mr. Connolly: Just for the sake of accuracy, I believe the guy, in the 2nd suit mentioned above, was complaining about more of a ( o ) :o ( o ) situation.

Years ago, when Sandy Spillman was the resident "medium" for the Magic Castle seances, one of the effects during the black-out segment involved a tambourine flying across the room.
One night, after the seance ended, one of the guests -- a lawyer... -- announced that he was going to sue the club because the tambourine had hit him in the head as it flew by.
Of course, Sandy showed him the effect with the lights on, revealing that it was accomplished using three tambourines and audial misdirection, hence it was physically impossible for him to have been touched by a tambourine at any time.
He quietly went away.
