Bill - it already IS a great resource for making purchase decisions. I've used it several times to help with decisions on what to buy - I haven't been disappointed. I'm planning on writing up a few more books when I get the chance - Books of Wonder, Vol 1 and Strong Magic. But you're right...the more people to take a small amount of their time to contribute, the better the site will get.

I don't want to sound like I am being a jerk (it is not my intention), but if the book is copywritten and it states that "No part of this publication may be reproduced or transmitted in any form or by any means ... without written permission" and you write up the table of contents of your favorite magic book, isn't that a violation?

Believe me, I understand wanting to know the table of contents and I can see how it could benefit someone or assist them in making the purchase, but is it right to do that (unless you have written permission)?

I am not a copyright attorney, though I do have some understanding of the law. Reproducing the table of contents exactly as it appears in the book would, I think, violate the copyright. The only reason you might be able to get away with it is something called "fair use," but I really don't know if a table of contents falls into that category.
The reason none of us who publish would complain about a table of contents being reproduced is because it's good publicity for us and our books. So, a good case could be made that it is helpful to the publisher rather than hurtful.

Don't worry - it's perfectly ok to question it. I believe, however, that this falls under the fair use rule. From www.nolo.com:

Subject to some general limitations discussed later in this article, the following types of uses are usually deemed fair uses:

  • Criticism and comment -- for example, quoting or excerpting a work in a review or criticism for purposes of illustration or comment.
  • News reporting -- for example, summarizing an address or article, with brief quotations, in a news report.
  • Research and scholarship -- for example, quoting a short passage in a scholarly, scientific or technical work for illustration or clarification of the author's observations.
  • Nonprofit educational uses -- for example, photocopying of limited portions of written works by teachers for classroom use.
  • Parody -- that is, a work that ridicules another, usually well-known, work by imitating it in a comic way.
In most other situations, copying is not legally a fair use. Without an author's permission, such a use violates the author's copyright.

I believe that the case of listing the tables of contents could rightfully fit into either the "Criticism and Comment" or "News Reporting" categories - more likely "News Reporting". We're summarizing what's in the book by using the Table of Contents. Other factors that weigh in on this: it's not for profit, it's not competing with the authors, it benefits the general public, we're not quoting a significant portion of the books (ie, we don't give away so much info that it would make buying the book worthless). I think you get the point - I believe that the site is fully covered by the current fair use laws.

In regard to describing any particular effect (Walkinoat's request above) I bugged Darwin on this and got the following response:

"I would rather not sell the book on the basis of one effect. I have found with my previous books that different readers are drawn to different effects. I expect the same to be true with "Scams and Fantasies with Cards."

Agreed, but there are only a small number of books indexed. It only helps me if there are books I haven't got... ;)

One of the reasons I did "Variations" was because of the amazing amount of interest that work has generated on places like eBay.

Likewise, when I was working on "Art of Astonishment" I was thinking about how much the set costs and thought if the contents were detailed it might help those who don't know a lot of Harris' work to start with the right volume.

Good Luck with "Strong Magic", I look forward to reading your summary. It's a must have book for anyone who likes to think about magic. Thank you Richard for publishing it.

Stuff all the Copyright stuff and thanks for all the information (especially the list of contents - "Combination Cull" has me interested already).

One quick question, does anyone on this forum know if Mr Ortiz will be attending the SAM Convention in NYC? I'd kinda like to get a copy while I am there, be a cool present to bring home.

Darwin emailed me yesterday on this. Apparently there's been a delay in the cover design and layout. But the cover was finished last week (and looks great) and the layout is due to be done by the end of this week, then it should be at the printers next week. I'd guess that would mean we won't see them until August...

The delay is driving me nuts, too!

Last Saturday, Darwin lectured at Denny and Lee's in Essex, MD and performed several effects from his upcoming book.

He performed the following effects:

1. Pass The Garbage

2. Hitchcock Travelers

3. The Color Of Money

4. The Professional

5. Combination Cull

6. Beat The Devil

7. Zen Master

8. God of Gamblers (performance only)

His new book has some incredibly solid and very commercial material. I am a huge fan of Darwin's work and his new book is one I have been looking forward to ever since he mentioned it last year.

At the lecture, Darwin also relayed the same info. that Andrew Wimhurst posted in reference to the delay in the printing of his book.

Believe me, when it comes out, this is one book you will want.

I had the pleasure of meeting Mark at Darwin's lecture at Denny's...Let me echo him in saying that the material that I saw is of a tremendous caliber...very impressive...

The Zen Master had me feeling like a layman all over again--an experience we all get too rarely...my jaw was definitely hanging in mid-air...it's a stunning piece of mindreading that's impeccably structured--there's a very beautiful "build" to the piece, it develops its own inertia...
its the kind of piece that has a right time and place, and the audience needs to be adequately impressed by prior material to be willing to devote to you time and attention...but when its right--is it ever right!
"The Color of Money" is a very commercial version of follow the leader--one i will be performing quite regularly...
the Travellers routine (the proper name escapes me and i'm too lazy to look it up in Mark's post) is very interesting as well...
all around...this looks to be a good book...having seen some of the material in person I highly recommend it!

Hi Mike, of course I remember you (you were an employee at MM's I believe). I'll e-mail you separately.

In all honesty, Darwin's new book has some incredible routines (probably some of his most commercial stuff yet). Wait till you see his handling for Color Monte in the trick he calls "The Color of Monte". Wait, that's not right. In all honesty, there are some incredible routines in this book. You will be pleased with it.

It really does, especially those of us who prepaid in anticipation of a June release as was advertised. Now it's nearing the end of August and still no "official" word of any release date. I just hope it lives up to the expectations.

Received this note from Darwin August 8th:

Off the record, the holdup on the book is the same thing it's been for many
weeks. The designer in charge of laying out the book has been dragging his
feet to an amazing degree. It's been a very trying experience.

In theory, the book should go to the printer within a week or two. (This guy
has reneged on so many deadlines, however, that I can't be sure until it
actually happens.) Once it goes to the printer, it should be a matter of six
to eight weeks before it's ready for shipping.

Well I for one am glad he did post it; I paid my money back in May expecting a release in June, I believe - and now it looks unlikely we'll be seeing the product until October. I honestly don't mind the wait - because I know I'll get it when it's done - but I think that such severe delays should be communicated so that people who have handed over their money know what's going on.

I agree, but it's Darwin's job to inform people. If he says something's off the record, it should stay that way, IMO.

You're absolutely right, Jamie. My only excuse is that I didn't want to post any information until I had a firm publication date. This can't happen until the book goes to the printer. If I had known it would take this long to get to the printer I wouldn't have waited to post. Unfortunately, the process has been more like Chinese water torture or the death of a thousand cuts. Each delay looked like it would only set things back a few days more. Until the next tiny delay. And then the next one and the next one.

Without going into details, I'll say that the problem has involved factors outside the control of either Michael Maxwell or myself. At the time that I started taking orders, it seemed certain that the book would be out soon since 99% of the work was done. All that remained was the brief (!) task of layout and design.

At this point it appears virtually certain that the book will go to the printer at the end of next week, at which point I will be able to post a publication date. (I'd be lying if I didn't admit that this isn't the first time I've believed that.)

I can only hope that the quality of the book and the deep discount I offered on pre-orders will make the wait worthwhile.

As to Jeff Eline's comment, “Never again,” I can tell you that I've uttered those words to myself upon finishing each of the seven books I've written. After the ordeal involved in getting this one to press, this time I may stick to my resolution.

I certainly doesn't hope so. Your books influenced me so much that not beeing able to put on my wish list "the next Darwin Ortiz' book" would be a pain.

I certainly believe that the delay regarding your book more than worth the wait.

I hate waiting for Darwin's book. But its only because they are so wonderful. I'll buy any of his magic books, sight unseen. They are practically guaranteed to be worth the wait. So far none of them have turned up on my continuous "for sale" pile! :)
