Interestingly, he makes sure to ask for sober, non-attorney adults who are in "good health". I'm curious if those lines were inserted as risk-mitigation by his legal team just 1) try to minimize risk of someone getting hurt and 2) to try and lay the groundwork for the defense against this sort of suit (i.e., that they are exercising due diligence). I'm no lawyer, so I'd be curious what you more knowledgeable folks think.

David hasn't done "13" in YEARS. This news is old, and the suit is old news. It has probably been resolved long ago.

It is noticeable in his current show the impact this and the previous law-suit have had. He's now the only person going inside any prop or standing in "drop zones", most of the stuff with spectators is done in the audience, the only time they are brought on stage is when it's absolutely essential, there's footprints/lines painted on the stage telling people EXACTLY where to stand and every spectator had a crew-member babysitting them 2 paces away and asking 101 questions before they're allowed to participate; they're not taking any chances!

Tom, have you seen the current show? He has spectators on stage quite a few times.
I don't think he took "13" out because of this lawsuit, but simply because he'd done it for over 10 years.

Last week
Yes he does have spectators on stage but it's only when absolutely needed (people were even brought to mic's at the side of the stage but not on-stage if they weren't needed to physically touch something on the stage) and every time there was a spectator on stage there's multiple crew members actively directing them and the stage deck looks like a dance instruction mat with all the lines and "stand here" notes for spectators.
Obviously when watching a performance i'm paying much more attention to technical and procedural issues like this but it really struck me how much more "managed" the spectators were compared to other performers and even just his previous shows. That's not a critisism, just an observation and in light of lawsuits seems like a sensible precaution to stop anyone successfully suing
